It explains the whole W-8BEN form and it's purpose - some of you guys might find it useful.

My one question is this - is it possible to claim back the 30% withholding tax if we file an international tax return? Some insight on this matter would be good as it is impossible for us to get an ITIN before launch.


You can call +1-267-941-1099 for an EIN immediately if you are a partnership (takes merely the time of the call). This way you can be exempt from the 30% taxation.

    I've never had to claim it, so I don't know off-hand what form it is.

    You can also claim a specific tax treaty article (ex: Germany US, Japan US are both article 7 I believe) to waive the 30% withholding. You do not need a tax id doing so too.

    For Amazon I've filled their online version of W-8BEN without providing ITIN (as an individual) and they accepted that (after verifying my documents - I had to send them some). I'm from Poland. And it was a few weeks ago, so I think you don't need ITIN really. Here is some discussion about it: http://www.proz.com/forum/business_issues/232238-need_an_itin_number_for_a_w_8ben_to_work_for_a_us_agency.html - the IRS is quite clear that in our situation you do not need ITIN (I'm talking about individuals, don't know about EIN for corporations) and OUYA shouldn't withhold any taxes for us.

    Yeah, the EIN is only for partnerships and corporations.

    Perhaps it is ok to waive the ITIN then..?

    Sorry to bring this topic to the top, but I'm struggling with this.

    So after reading all that I can about this, I want to ask:

    Can I fill the W-8BEN as individual to sell games on OUYA store?

    Also, What about ITIN? is it really needed?

    And, just to complement, I'm from Chile.

    @Magnesus Could you elaborate on how you got Amazon to accept W8? They've been holding me up for an ITIN, which I cannot get without great difficulty.

    I just filled the form, that's it. It probably depends on country though. And I probably provided my VAT EU number which might have helped (it was long ago, so I don't remember).
